Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Kontext websites, applications, APIs, and related services (the “Service”). By creating an account, accessing the Service, or opting into Kontext messaging programs, you agree to these Terms.
1. The Service
Kontext provides software tools for building, running, and operating applications and business workflows, which may include messaging, voice, automation, identity, and related features. Features available to you depend on your plan, configuration, and applicable law.
2. Accounts and eligibility
- You must provide accurate account information and keep it up to date.
- You are responsible for activity under your account and for safeguarding credentials and devices used to access the Service.
- If you use Kontext on behalf of a business, you represent that you have authority to bind that business to these Terms.
3. Acceptable use
You agree not to misuse the Service. Prohibited conduct includes, without limitation:
- Sending spam, unlawful, deceptive, harassing, or abusive communications.
- Messaging people without required consent under applicable law and carrier rules (including TCPA and CTIA guidelines where applicable).
- Attempting to bypass security, rate limits, opt-out systems, or messaging compliance controls.
- Infringing intellectual property or privacy rights of others.
- Using the Service for illegal activity or to distribute malware.
SMS / messaging program terms
By opting in, you agree to receive SMS and/or MMS from Kontext and/or businesses using Kontext for the program described at opt-in (for example account alerts, appointment reminders, customer care, and service updates).
Message frequency varies.
Message and data rates may apply.
Reply STOP to opt out. Reply HELP for help, or email
team@kontext.network.
Consent to receive texts is not a condition of purchasing any goods or services. Carriers are not liable for delayed or undelivered messages. Our collection and use of mobile numbers and messaging consent is described in our Privacy Policy.
4. Customer content and messaging responsibility
If you use Kontext to message your own customers or contacts, you are solely responsible for obtaining and documenting required consent, providing required disclosures (including links to your privacy policy and terms where required), honoring opt-outs, and complying with carrier and legal rules. You must not use purchased or scraped lists without valid consent.
5. Fees
Paid plans, usage-based charges (including messaging and phone usage where applicable), and third-party pass-through fees are described in-product or in a separate order. Fees are non-refundable except where required by law or expressly stated otherwise.
6. Intellectual property
Kontext and its licensors own the Service, branding, and underlying technology. You retain rights to content you submit, and you grant Kontext a license to host, process, and transmit that content as needed to operate the Service for you.
7. Third-party services
The Service may integrate with third parties (for example identity providers, payment processors, and communications providers). Their terms and privacy policies apply to their services. Kontext is not responsible for third-party services it does not control.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, KONTEXT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KONTEXT AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION. KONTEXT’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO KONTEXT FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
10. Indemnity
You will defend and indemnify Kontext against claims, damages, and expenses arising from your content, your messaging practices, your use of the Service, or your violation of these Terms or applicable law.
11. Suspension and termination
We may suspend or terminate access for violations of these Terms, legal risk, non-payment, or to protect the Service or others. You may stop using the Service at any time. Provisions that by their nature should survive will survive termination.
12. Changes
We may update these Terms by posting a revised version on this page. Material changes will update the “Last updated” date. Continued use after changes become effective constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict-of-law rules, except where mandatory local law provides otherwise. Courts in that state will have exclusive jurisdiction, except where prohibited.
